ファーガソン事件をめぐって アメリカの希望、そして現実

破壊や略奪はつきものだが、多くの人々が心底から怒っていることは間違いない。なぜか? 今回の事件には背景があったからだ。

アメリカは建国以来「法の下の平等」という精神に支えられてきた。この言葉は、私たちの大切な憲法を守る法の殿堂である合衆国最高裁判所の屋根の下に刻まれている。

悩ましいことに、あるいはより悪いことに、人種問題をめぐる私たち自身の矛盾と偽善のせいで、この気高い精神は損なわれている。

この矛盾と偽善が南北戦争を引き起こしたのだし、今日でも私たちの公的生活のさまざまな場面で語られる緊張の核心をなしている。そう、私たちはバラク・オバマを選んだ、それも二度にわたってだ。でもそれはこの物語の結末にはまだほど遠い。

法の下の平等と人種差別の苦悩の間にある矛盾を象徴するような事件が、またミズーリ州ファーガソンで起こった。誰もが皆、残念だが当然の成り行きだと受け止めた。はたして私たちの理想は叶うのだろうか。

とにかく試してみること。それこそが私たちのDNAである。でもその道はまだはるかに長そうだ。

すでに世界中の人々がこの事件のあらましを知っている。この国の警察官はほとんど白人で構成されているのだが、一人の白人警察官が拳銃を放ち、アフリカ系アメリカ人の多い地区で黒人の青年を殺した。

11月24日夜、セントルイス検察は寄せられた証言に基づいて、州法に照らし警察官のダレン・ウィルソンを不起訴とすると発表した。この検事は「ウィルソンは公的な職務に許される範囲内で妥当な行動をしたと考えられる」と述べた。犠牲者となったマイケル・ブラウンが強盗犯ではないかと疑い、自身やその場にいた同僚が殺される危険を感じる理由がウィルソンにはあった、と判断した。

穏やかな口調で述べられたこの決定は、その背景を考慮に入れなければ、十分公正に聞こえる。しかしこの発表はセントルイスの街路やアメリカ各地に新たな騒乱を引き起こした。破壊や略奪はつきものだが、多くの人々が心底から怒っていることは間違いない。

なぜか?

今回の事件には背景があったからだ。

批判的な意見を述べる人たちによると、州法と、実際にそれを運用している状況を見るに、おおむね警察官の犠牲者になる側に厳しくなっている。今回の事件は、とりわけ犠牲者となったマイケル・ブラウンが不利な扱いを受けている。

アメリカの法律では、地方検事の裁量で被疑者の起訴・不起訴が決まる。今回の検事は、警察官の不祥事には警察官側に同情的な姿勢をとりがちだと知れ渡っているので、自分で判断することを避けた。

そうして彼は非公開の予備審問 (大陪審) に判断を委ねた。通常であれば、この種の審問では検事たちは判定に十分な証拠だけを提示する。公正な裁判を要求するのに都合がよいように。

しかし今回、ボブ・マカルー検事は予備審問に警察とFBIが集めた証拠をすべて提出した。

自分が直接関わらない形にしながら、彼の望む方向に予審を導こうとしたのは明らかだ。

つまり、彼がこの事件を実質的に裁判にかけて指揮したようなものだ。そこでは (後から公開された記録によれば) この検事はウィルソンと彼に都合の良い証言者には好意的な態度を取り、反対の立場の証言者には厳しく当たったことが分かる。

州法もウィルソンにとって有利に働いた。ミズーリ州の法律では、警察官が身を守るための「武器の使用」は幅広く認められている。実際、1985年に出された合衆国最高裁判所の判例に比べても幅が広い。多くの州でこの判例に従って州法を修正する作業が進められてきたが、ミズーリ州ではその作業が遅れていた。

こうしたことがいずれも人種差別が動機ではなかった、と仮に考えてみよう。セントルイスのような土地では白人の警察官が黒人を撃つ場合が圧倒的に多い。

セントルイス周辺は歴史的に多数の奴隷を抱えていた南部だ。秩序を大切にする気風が多い中西部にも属する。この街とその郊外では多くの人種がはっきり分かれ、それぞれ集まって居住しており、隣り合う地区でも住んでいる人々が明白に異なることがある。

セントルイスは例外ではないかと考える人もいるだろうが、そうではない。アメリカではどの町でも、ワシントンDCでさえ、人々は人種別、そして収入別に分かれ、それぞれが集まって居住している。

1776年に私たちは独立宣言で「すべての人間は生まれながらにして平等である」という精神を大切に守ると誓った。私たちは、選挙によって選ばれた私たちの代表によって書かれ、現在適用されている法を、何よりも優先してまず信じる、と言える。

そこに、セントルイスも含まれるはずだ。
