GoogleやAmazon、Appleの法人税逃れにイタリアが課税へ 「ダッチ・サンドイッチ」とは

GoogleやAmazon、Appleなど国際的な企業に、実質的な法人税を課税する法案が、イタリアで12月23日に成立した。

GoogleやAmazon、Appleなど国際的な企業に実質的な法人税を課税する法案が、イタリアで12月23日に成立した。

イタリア上院は23日、「グーグル税」と呼ばれる課税を盛り込んだ2014年予算案を、下院に続き賛成多数で可決した。グーグル税の導入を決めたのは、欧州連合(EU)では同国が初めて。

グーグル税は、グーグルやアマゾン、アップルといったインターネット広告ビジネスを展開している多国籍企業が対象。イタリアで広告を出す場合、同国企業を通じた取引を義務付けることで、税収を確保するのが狙いだ。税収は年間1億〜1億5000万ユーロ(約140億〜210億円)と見積もられている。

法案によると、多国籍ネット企業が直接課税されるわけではないが、ルクセンブルクやアイルランド、欧州連合(EU)域外の低税率国・地域を通じた広告などを抑制。ネット企業にイタリア企業を利用した広告を義務付ける内容となっている。

GoogleなどのIT企業は、国境を超えてサービスを展開しているが、拠点をアイルランドなど税金の安い別の国に置き節税しているとされ、EUやアメリカ政府などが問題視していた。

最近、あの有名企業も、タックスヘイブンがらみで話題になった。米アップルだ。手口は、アイルランド政府と法人税率を2%以下にすると合意し(通常は12・5%)、アップルが同国に設立した子会社に利益を蓄えていた。結果として、米国の法人税を脱税していたと米議会から指摘されたのだ。

だが、あくまで各国の税制の違いをうまく利用しているだけで、違法行為でないため、対応が難しいのが現状。イタリアの法制化は、それを打ち破る事例となった。

3社は複雑な税制の仕組みを調べつくし、税金を支払わなくてもよいスキームを考案、実行していると考えられている。例えば英国のスターバックスは、英国で発生した利益を、オランダの関連会社にロイヤリティを支払う形で消滅させている。英国ではみかけ上、利益が発生しないので課税の対象とならない仕組みだ。他の2社も同じような節税スキームである可能性が高い。

同社の取り組みは不誠実ではあるかもしれないが、脱税と認定することは難しい。すくなくとも、これまでの法解釈や脱税の前例に照らし、税務当局は追徴に踏み切ることに躊躇したと思われる。議会からの圧力を受けて、ようやく同社は当局との交渉を始めており、何らかの形で税金を納めることになる可能性が高いという。

Googleが用いる手法は、「ダッチ・サンドイッチ」と呼ばれているという。

グーグルの会計手法は、アイルランド子会社から利益を合法的にタックスヘーブンとして知られるバミューダへ移転するのだが、一度寄り道をしなくてはならない。アイルランド子会社にいったん集められた利益は、まず同国での源泉徴収を避けるためオランダに移転させる。

アイルランドとオランダは、いずれも欧州連合(EU)加盟国であるため、アイルランドの税法では他のEU加盟国に支払われる特定のロイヤルティーについては免税とされている。その後、グーグル・ネザーランズ・ホールディングスは受け取った額の99.8%をバミューダへと移す。オランダのグーグル子会社には従業員は一人も登録されていない。

オランダが2国の間に挟まれていることから、この手法には「ダッチ・サンドイッチ」の名が付けられた。
