8月9日、黒人少年のマイケル・ブラウンさんは丸腰で両手を挙げていたにもかかわらず警官に射殺され、抗議デモが相次いでいた。
ニクソン知事はブラウンさんが死亡した8月9日以降、ファーガソン市内やセントルイスなど他の地域で発生した「一連の社会的混乱」に触れ、大陪審の決定後に暴動が発生する危険を防ぐ目的で、この行政命令をミズーリ州の市民と経済を「暴力と被害」から守る手段として発表した。
ニクソン知事は、行政命令の中で「ミズーリ州のハイウェイ・パトロールと共に、セントルイス郡警察、セントルイス都市警察に対して、合同チームを組織し、ファーガソン市、そしてセントルイスの市民の権利保護と治安確保を行うように指示する」と述べ、市民が平和的に集会を行う権利の確保について言及した。
デモ参加者たちはすでに、ファーガソン、セントルイスとその周辺地域の各所で抗議活動を始めている。そんな中、ウィルソンの起訴に関する大陪審の決定が下される見込み。17日、抗議活動グループの1つはクレイトンで集会を行った。クレイトンでは大陪審が審議中である。他のグループは、ユニバーシティ市で「ダイイン」（die-in）を展開した。ダイインは、路上に横たわり射殺された真似をする抗議活動である。
