NHK受信料は「ワンセグ携帯も対象」 高市早苗・総務相、地裁判決に反論

高市早苗総務相は2日の閣議後記者会見で、ワンセグ機能付き携帯電話はNHKの受信契約義務が生じないとしたさいたま地裁の判決に関し、見解を述べた。

NHKの受信料についてワンセグ放送を受信できる携帯電話を持っているだけでは支払う「義務はない」と、さいたま地裁が8月に判断したことについて、高市早苗総務相は9月2日の閣議後の記者会見で「携帯受信機も受信契約締結義務の対象だと考えている」と述べた。NHKニュースなどが報じた。

高市総務大臣は閣議のあとの記者会見で、「総務省としては、受信設備の『設置』という意味について、『使用できる状態におくこと』と規定したNHKの放送受信規約を認可しており、従来から、ワンセグ付きの携帯電話も受信契約締結義務の対象だと考えている」と述べました。

また、高市大臣は「NHKはただちに控訴するというコメントを出している。総務省としては、訴訟の推移を見守ってまいりたい」と述べました。

裁判では、ワンセグ機能つき携帯電話の所有者が、放送法64条1項で受信契約の義務があると定められている「放送を受信できる受信設備を設置した者」にあたるかが争われた。さいたま地裁は8月26日、携帯電話の所持が放送法上の「受信設備設置」に当たらないと判断してNHK側の主張を退けた。
