フロリダ州のフォートローダーデール市は11月2日、「公共の場でホームレスの人々に食べ物を与えた」のは条例違反だとして、90歳のアーノルド・アボット氏を逮捕した。

地元ニュースサイト「Local 10」の記事によると、海岸でホームレスに食事を配ろうとしていたアボット氏と2人の牧師に、警察は出頭を命じた。地元紙「Sun Sentinel」が報じたところでは、アボット氏らが用意した300人分の食事のうち、ほんの数人分を提供した段階で、警察が介入したという。

逮捕の根拠となったのは、慈善団体が屋外の公共の場所でホームレスの人々に食事を与える活動を制限する、同市の新しい条例だ。激しい抗議活動が行われたにもかかわらず、10月22日に成立した。

この新しい条例は、「公衆の保健と安全のため」に、屋外で食事を提供するプログラムを1街区につき1つのみに制限し、かつ住宅地から少なくとも500フィート(約150メートル)離れた場所で行わなければならないと定めている。また、「Sun Sentinel」によれば、条例はそうした活動を行うグループに対し、移動式トイレの設置も要求している。

市の条例に違反した2人の牧師とアボット氏は、60日間の禁錮と500ドルの罰金を課される可能性がある。しかし、アボット氏は、逮捕から4日後の11月6日にはフォートローダーデールの海岸で活動を再開し、その場で再び警察への出頭を求められたと、AP通信は報じている。

Local 10が11月9日に開いた、ジャック・セイラー市長との公開討論で、アボット氏は市長の意見に真っ向から反対し、「自身の信念に従って活動を続ける」と明言した。

セイラー市長は、アボット氏の信念は尊敬に値すると述べたが、そうした活動は「適切な場所」で行ってほしいと求めた。これに対し、アボット氏は、屋内の活動場所を確保しようと「何度も何度も」試みたが、使わせてくれるところはなかったと反論した。さらにアボット氏は、屋内でホームレスたちに食事を与えられるような場所を探すという市長の「約束」が果たされるのを待つが、それまでは屋外での活動を続けると話している。

「この人たちは、貧しい人たちの中でも最も困っている人だ。何も持っておらず、雨露をしのぐ家さえない」とアボット氏は述べ、市を相手取って裁判を起こすつもりだという。

アボット氏は、キリスト教の布教活動グループ「Love Thy Neighbor(汝の隣人を愛せよ)」の創立者で、20年以上にわたって、こうした支援活動を続けてきた。活動家やホームレスの人々の間では「シェフ(料理人)アボット」と呼ばれている。

第2次世界大戦を経験した退役軍人でもあるアボット氏は、Sun Sentinelに対し、「自分の体が息をしている限りは活動を続ける」と語っている

なお、ホームレスに食事を与える活動を制限する条例は、同市だけのものではなく、その数は増えている。「全米ホームレス支援会」(NCH)が最近行った調査によると、2013年の1年間だけでアメリカの21都市が、ホームレスの人々に食事を与える活動を制限する規則や条例を成立させた。その多くは、公共施設の利用を認めなかったり、厳しい食品安全規則を適用したりするものだ。

また、NCHによれば、フロリダ州は、2013年にホームレスが被害者となった傷害事件の発生件数が、全国で2番目に多かったという。フロリダ州は2010年に、ホームレスの人々に危害を加えることはヘイトクライム(憎悪犯罪)であると宣言している。

なお、アメリカでは、「過去1年間に、家族のために食べ物を買うお金がなかったことがある」と答えた人の数が全体の24%に上るという調査結果(日本語版記事)もあり、先進国では特異な国になっている。文末スライドショーの1つ目では、「過去12カ月で少なくとも1回お金がなくて食べ物を入手できなかったことがある」と答えた人の率が最も多いアメリカの州のランキングを紹介しているが、2013年の調査結果によると1位はミシシッピ州で、その率は25.1%。10位のアリゾナ州で21%だ。
