みずほ銀行もビットコイン訴訟の矛先に アメリカ・カナダで賠償請求が相次ぐ

両訴訟とも、マウント・ゴックスに不正行為があったとし、取引銀行としてのみずほ銀の責任を追及している。

米国でみずほ銀行を訴えているのは、イリノイ州在住のグレゴリー・グリーン氏。同氏は2月のマウント・ゴックス閉鎖によって2万5000ドル相当の損失を被ったとしてすでに同社を提訴していたが、14日、シカゴ連邦裁判所に集団代表訴訟として修正訴状を提出し、みずほ銀行などを被告に追加した。

修正訴状は、みずほ銀がマウント・ゴックスの資金と同社顧客の資金を区別せず、同社の不正を知りながら銀行サービスを提供、「利益を得た」疑いがある、としている。みずほ銀は同社やその顧客に代わってビットコイン以外の通貨を口座に保管していた。同訴状では、新たに2人のマウント・ゴックスの役員、Jed McCaleb氏とGonzague Gay-Bouchery氏も被告に追加している。

さらに、カナダでも同日、マウント・ゴックスを通じてビットコイン取引をしていた複数の利用者が、同社とみずほ銀行を相手取りオンタリオ高裁に集団代表訴訟(クラスアクション)を起こした。

訴状によると、原告側は同社に預けていた通貨とビットコインが引き出せなくなったとし、同社の長期にわたるセキュリティー違反が「利用者の数百万カナダドルにも及ぶビットコイン盗難」につながったと指摘。みずほ銀行については、「マウント・ゴックスが利用者から受け取ったビットコイン以外のすべての通貨が(同行の)口座に預けられていた」としている。

これらの訴訟について、みずほ銀の広報担当者はコメントを差し控えている。米国でマウント・ゴックス側の代理人を務めるベーカー&マッケンジー社の弁護士、John Murphy 氏からのコメントもとれていない。

マウント・ゴックスは2月28日、同社と顧客分の計85万ビットコイン(時価で約560億円)のほぼすべてが失われたほか、預金残高が最大28億円不足しているとして、東京地裁に民事再生法の適用を申請した。さらに、3月12日には米国の裁判所に連邦破産法の適用を申請、受理されている。

みずほ銀とマウント・ゴックスの関係については、同社のマルク・カルプレス代表とみずほ銀担当者との会話がネット上に流出。同社の信頼性に疑問をもったみずほ側担当者が口座閉鎖を迫る一方、カルプレス代表が強く拒否するなど、緊迫したやりとりがあったことが明らかになっている。
