日本側がアメリカの反捕鯨団体シー・シェパードに和解金として金銭を支払う一方、調査捕鯨への妨害行為を「永久に行わない」とした合意について8月23日、調査捕鯨の妨害の実行部隊であるシーシェパード・オーストラリアが無視する意向を表明した。

シーシェパード・オーストラリアの幹部、ジェフ・ハンセン氏は「アメリカの裁判であり、オーストラリアの私達には関係ない」と話したと、BBCなどが報じた。

英紙ガーディアンによると、ハンセン氏は「オーストラリアのクジラ保護区でのクジラの虐殺を禁止するオーストラリア連邦裁判所の判決の効力が残っている。アメリカの裁判所での和解は、オーストラリアでは法的な効力は全くない」と述べ、今後も妨害を続ける考えを示したという。

共同通信によると、日本鯨類研究所が、アメリカとオーストラリアのシーシェパードはそれぞれ法的には「独立している」ため、合意の効力がオーストラリア側には及ばないことを確認したと報じた。ただし今回の和解により、事実上の本部とみるアメリカ側からの資金や人材の提供が禁止されるため、妨害活動には打撃となると指摘したという。
