オクラホマの州法では1920年代から、犯罪時にフードやそれに似たもので頭を覆っていると「身元を意図的に隠している」と見られ、さらに罪が重くなる。もともとはクー・クラックス・クランによる暴力を抑制するという狙いがあって作られた州法だ。だが新たに提出された法案は、たとえ犯罪とは関係がなかった場合でも、公共の場所でローブや、マスク、その他変装するための衣装によって自分の身元を意図的に隠すこと」を禁じている。この法律を破った場合は軽犯罪で逮捕され、500ドル以下の罰金を科せられる可能性がある。

法案では、例外的に許可される場合として「宗教的衣装、荒天用の服装、安全や医療目的、パレードやハロウィーンのお祝い、仮装パーティ、ミンストレル・ショーの一団、サーカス、スポーツのチーム、マスコット、その他の娯楽や演劇などのショーなど」を挙げている。しかしKFORが取材した住人たちは、法案はあまりに曖昧であり、フード付きの服をどんな場所でも禁止することを意図して、簡単に間違った解釈をされてしまうおそれがある、と不安を口にした。

オクラホマシティの検事ジェームス・サイデリアス氏は「これは公共の場の秩序と道徳の領域を侵さない限り何を着ても良い、という個人の権利を侵害するものだと思うし、非常に大きな問題になりうる」と述べている。

インタビューに応じたトレーシー・ウィハゲン氏は「髪型が上手く決まらなかったとか、がん患者であるとか、髪の毛が薄くなり始めているとか、フードをかぶる個人的な事情があることもありえる。なぜフードをかぶるのか、他の人に理由はわからない」と答えた。

法案を提案した、共和党員のドン・バリントン上院議員は、法案の目的は犯罪防止だけだと述べた。

「この法案の目的は、犯罪やハラスメント目的で顔を隠せないようにすることで、ビジネスや公共の場所をより安全なものにすることだ。これに似た州法はずっと前からオクラホマにあったし、他の州でも同じような法律はある」とバリントン上院議員は述べている。「オクラホマの経済界は、州に安全対策を講じてほしいと望んでおり、この法案はその要望に応えるものだ」

2012年にフロリダで、武器を持たずフードつきのスウェットシャツを着ていた黒人の少年トレイボン・マーティンさんが射殺された事件は、アメリカ中で抗議運動を引き起こした。抗議した人々の中にはNBAのレブロン・ジェームズや議員たちも加わっており、彼らは皆マーティンが死亡したときの服装にあわせて、フード付きのスウェットシャツを着ていた。フード付きのスウェットシャツはタイム誌の表紙を飾っている
