アメリカ・ジョージア州で睡眠中のゲイカップルに熱湯をかけて大やけどを負わせた男に対し、フルトン郡上級裁判所の陪審員は有罪判決を下し、懲役40年が言い渡された。AP通信が報じた。

マーティン・ブラックウェル被告(48)は2月12日、アンソニー・グッデン・ジュニアさん(23)、マルケス・トルバートさん(21)のゲイカップルに対する8件の加重暴行罪と2件の加重脅迫罪に問われていた。2人は、2〜3度の大やけどを負い、今も治療中だ。

ブラックウェル被告は、事件当時グッデンさんの母親キム・フォスターさんと交際していた。ブラックウェル被告は法廷で、フォスターさんの自宅に帰宅した時、グッデンさんとトルバートさんがセックスしていたと主張した。

「たった1つの行動が、被害者に大きなダメージを与えました。不快で、卑劣な行為でした。でも、致命的な行動ではありませんでした。突発的なものだったのです」と、モニーク・ウォーカー弁護士は陪審員に説明した。

しかし、最終的に陪審員は判決でこうした主張を退けた。熱湯を沸かすのに「長い時間がかかる」と述べた上で、ヘンリー・ニューカーク裁判長は、ブラックウェル被告が故意に犯行に及んだは明らかだと判決で述べた。

ブラックウェル被告は、ジョージア州ではヘイトクライムとして起訴されなかった。ジョージア州でヘイトクライムに関する法整備がされていないためだ。それでも、ロイター通信によると、連邦捜査局(FBI)のスポークスマンは捜査官がブラックウェルを連邦法に基づいてヘイトクライムの容疑で起訴する意向だという。
