ドナルド・トランプ大統領は2月16日、フロリダ州の元連邦検事R・アレキサンダー・アコスタ氏を新たに労働長官として指名した。

指名が確定すれば、アコスタ氏はトランプ氏の内閣で初のヒスパニック(中南米系)となる。

アコスタ氏は、ジョージ・W・ブッシュ元大統領の時代に全米労働委員会(NLRB)の委員を務め、また市民権局で司法次官補も務めた。マイアミ出身のアコスタ氏は、最近ではフロリダ国際大学法科大学院長を務めた経歴がある。

アコスタ氏はかつて論争の的になったことがある。2014年にフロリダ大学レビン法科大学院の学部長候補として指名を受けたとき、大学はアコスタ氏が投票時に有権者に本人確認(ID)を求める「有権者ID法」制定に露骨な根回しをしたという理由でアコスタ氏の指名を拒否した。表向き有権者ID法には不正投票を防止するという目的があるが、不正投票は事実上存在しないも同然だ。有権者ID法は、マイノリティや高齢者の投票を妨害するといわれている。2004年、当時司法次官補だったアコスタ氏はオハイオ州の判事に書簡を提出し、共和党議員は投票者資格に異議を申し立てる権利があるとして有権者ID法を擁護している

「我が学部では、学部長にふさわしくない人物としてアコスタ氏の指名を拒否した」と、レビン法科大学院のミシェル・ジェイコブス教授は2014年3月、新聞の論説に寄稿した

一部の保守派から、リベラル寄りのレビン法科大学院がアコスタ氏の政治的思想を理由に指名を拒否したという批判があった。

ジェイコブス教授の論説に対し、カリフォルニア大学ロサンゼルス校法科大学院のステファン・ベインブリッジ教授はブログで「アコスタ氏の落選は、不正投票の問題が大きな懸念となっていた当時、アコスタ氏が共和党検事として司法省に務めていたことが原因かもしれない。これは由々しき事態だ」と批判した。「今、保守的な法律学者はフロリダ州を避けるべきだ」

パズダー氏の指名に反対した労働組合は、アコスタ氏も最低賃金の引き上げや、団体交渉権を支持しないなら引き続き承認に反対すると発言した。労働者の団体交渉権は、共和党が多数を占める議会ですでに批判の対象となっている。

「トランプ大統領が新労働長官に指名したアレキサンダー・アコスタ氏は、アメリカの労働者にとって最も重要な事項に関し、徹底的な審査を受けるべきだ」と、 NPO「全国雇用法プロジェクト」執行取締役のクリスティン・オーウェンズは声明で語った。「アコスタ氏に対する厳しい審査は実施してもらう」

■ 当初指名していたパズダー氏はスキャンダル続出で辞退

トランプ氏は当初、ファストフードチェーンの「カールスジュニア」や「ハーディーズ」の親会社CKEレストランツのCEOアンドリュー・パズダー氏を指名していた。しかし、パズダー氏が経営するファストフードチェンが訴訟を抱え、過去に労働法違反を犯し、パズダー氏自身も不法移民の家政婦を雇用し、家庭内暴力で元妻に起訴されるといった問題を抱えていた。上院保健・教育・労働・年金委員会は、パズダー氏の指名公聴会を5回以上先送りにした。

共和党ではパズダー氏を擁護していたが、長年にわたって移民増加を支持してきたパズダー氏の姿勢に批判が集まり、擁護の声は消えていった。パズダー氏は、民主党議員と無所属議員からの賛成票を確約できなかったため、共和党上院議員52人中少なくとも50人の賛成票が必要だった。2月初め、資産家のベッツィ・デボス氏を教育長官として承認する際にも上院議会で賛成票と反対票が同数となり、議長を兼任するマイク・ペンス副大統領が1票を投じて承認が決定した。パズダー氏にも同じような状況が起きた可能性があった。

労働組合を支持母体とする民主党議員は、アメリカの労働者のための賃金引き上げや労働基準の向上を提唱する労働省のトップとしてパズダー氏を起用するのはふさわしくないと主張した。パズダー氏が所有するCKEレストランツでは、低賃金で働く従業員に対する賃金の引き上げを繰り返し拒否した。またパズダー氏は従業員のことを「最低の人々のなかで最良な人々」と中傷したことがあった。パズダー氏はまた、「従業員は機械化されるべきだ」と、労働者軽視の発言もしている。パズダー氏は、2012年にファストフード店員によるストライキが拡大して以来労働組合から目標として掲げられている「最低賃金の時給15ドル引き上げ」にも反対している
