参院議長の山崎正昭氏（自民）は9月25日、山本太郎参院議員を議長室に呼び、厳重注意をした。18日の参院本会議に喪服で出席し、安倍三首相の問責決議案の投票で、焼香のしぐさをしたり、安倍首相や自民党席に向かって合掌したりしたことを問題視した。時事ドットコムなどが報じた。

山崎氏は「次は容赦しない。議員バッジを外すことになるかもしれない」と述べ、国会法に基づく除名をちらつかせて警告。「神聖な本会議場の品位を汚す行為だ」と批判した。

これに対し、山本氏は「安全保障関連法の強行採決は、議会制民主主義を破壊する行為であり、それに対する自分としての表現だった」と説明。その後、記者団に対し「山崎議長が公平な立場で見て、厳重注意が妥当だというのであれば、謹んでお受けするしかない」と述べた。

なお、山本氏の参院本会議での焼香などのしぐさについては、次世代の党の参院議員・和田政宗氏は「宗教的儀式」と批判。「政教分離という憲法の原則からしても、極めて、やってはならない行為。絶対に許してはいけない行為であり、懲罰に値するだろうと思っている」と指摘していた。憲法20条は政教分離について触れており、「国及びその機関は、宗教教育その他いかなる宗教的活動もしてはならない」としている。
