同性愛や性同一性障害など、性的マイノリティ（LGBT）のための法整備を求める「LGBT法連合会」は5月19日、都内で会見し、性的指向や性自認による差別を禁じ、政府に基本方針の策定を求める法律の市民案を発表した。今後は、政府や国会議員に働きかけ、立法を目指す。
「LGBT法連合会」は、LGBTを支援する全国のNPOや弁護士らでつくる団体。学校、職場、医療、公共サービスなどのあらゆる分野で、LGBTへの直接的、間接的な差別やハラスメントをなくすための基本方針を政府が定め、企業向けのガイドラインを策定するよう国に要求。行政による指導・監督も盛り込んだ。市民案の全文はこちらで読むことができる。
「LGBT法連合会」主要団体のみなさん
神谷悠一事務局長は会見で、国の補助金で運営されている「寄り添いホットライン」には、LGBTに関する相談が年間約64万件寄せられていることや、相談者の約3分の2が、自殺を考えるほど精神的に追い込まれていることなど深刻な現状を訴えた。
続いて、「LGBT差別禁止法」の考えかたを、具体的な事例に挙げて説明した。市民案には、以下のように直接・間接差別の禁止のほか、LGBTハラスメントや報復の禁止なども含まれている。
■直接差別の防止および禁止
トランスジェンダーであることを理由に、企業が就職面接を中断するなど。
■間接差別の防止および禁止
結婚していることを要件とする各種手当など。
■LGBTのハラスメント防止および禁止
「ゲイっぽい」「オカマ気持ち悪い」などの発言は禁止。
■合理的配慮義務
トランスジェンダーのトイレなど配慮の義務が必要。
■報復の禁止
LGBT差別の禁止を申し出たことで、当人が不利益を被らない。
同団体の永野靖弁護士は「性的指向や性自認は自ら選べず、変えられない。同性愛者は、必ずしも見てわからない。行政職員が
『私たちは知っています』という姿勢であれば相談しやすい。法的根拠があれば、差別解消も進んでいく」などと話した。
