イタリア上院、同性カップル権利法を可決　レンツィ首相「歴史に残る日」

イタリア上院議会は2月25日、結婚に準じた権利「シビルユニオン」を同性カップルに認める法案を、賛成多数で可決した。今後、下院で審議される予定。BBCなどが報じた。

シビルユニオンとは、同性同士のカップルに対しても、法律婚と同様に遺産相続や養子縁組、養育などの法的権利を認めるもの。この日の採決の結果は、賛成173、反対71だった。マッテオ・レンツィ首相は「歴史に残る日になる」と語った。

毎日新聞によると、イタリアでは憲法で家族を「婚姻に基づく自然な共同体」と規定しており、西欧主要国の中で唯一、同性婚やシビル・ユニオンを公的に認知する制度がない。同性婚をタブー視するカトリックの総本山、バチカン（ローマ法王庁）のお膝元ということもあり、カトリックの上院議員から根強い抵抗があったためだ。

イタリア司教協議会のパオロ・ジェンティーリ神父が「法案では、同性パートナーが以前の異性配偶者との間にもうけた継子が養子となるケースが想定され、受け入れられない」と指摘するなど、反対派の抵抗で、当初の法案に含まれていた養子に関する条項が削除された。このため同性愛団体は、強く反発している。

イタリアに対しては、欧州人権裁判所は2015年7月、イタリア政府に対し、同性カップル3組に婚姻やそれに準じるパートナー関係を認めなかったことは人権侵害にあたるとする判決を下し、イタリア政府に損害賠償の支払いを命令。法整備の必要性を問う声が強まっていた。
