私は朴槿恵大統領の風刺画を描いて、懲役刑を求刑されました。

私は間違ったことはしていません。風刺をしなくていい、集会に出る必要もない社会にしてくれればいいのです。

裁判を受けてきました。検察が懲役1年6カ月を求刑しました。耳を疑いました。呆れて怒って涙が出ます。

今回の検察の求刑も、以前のように罰金刑を予想していたので、懲役という言葉に驚きました。怖くはありませんが、どう対処すればいいのか混乱しました。幸いにも多くの方が助言してくださいました。応援して頂き、そして心配して頂いたことに感謝します。ひとりでないということ、私個人だけの問題ではないということを心に刻んで準備します。

2014年のセウォル号沈没事故の犠牲者追悼集会でパフォーマンスしたことが一般交通妨害罪、市民と警察の絵を描いたこと、大統領の風刺画を描いたことは財物損壊罪に問われています。パフォーマンス、風刺画の裁判について、具体的な状況をお知らせします。

1つ目の一般交通妨害罪は、2014年8月15日、セウォル号沈没事故の犠牲者追悼集会でのパフォーマンスです。セウォル号犠牲者追悼を象徴する黄色いリボンをモチーフに、黄色い布を破いて、釣り竿に吊るして行進しました。海の中にある真実をすくいあげるという表現であり、風が吹くたびにはためき、鐘の音が鳴る釣り竿です。このパフォーマンスは「3000人と共謀し、道路を不法占拠」したと起訴状に書かれています。このとき私は、作家イ・ハ氏の天気雨プロジェクトというアートプロジェクトでパフォーマンスした直後、集会に参加しました。この件は罰金300万ウォン(約27万円)の仮納付命令を受けた状態でした。

2つ目の財物損壊罪は、2015年11月に作成した風刺画です。国定教科書に朴正煕大統領の顔が描かれています。水鉄砲がその教科書を撃っています。もうひとつは、市民が警察の目に入った催涙液を拭いている写真を見て描いた絵です。両方とも、ソウル・弘益大学付近の工事現場の仮囲いに描いたところ、この仮囲いは絵が描かれた翌日に撤去されました。この件は在宅起訴されました。

訳注:韓国の軍国主義の象徴とされる旭日旗を背景に、朴槿恵大統領が手を振っている。その下には日本語で「サヨナラ」と書かれている。旧日本軍の軍人出身で、日本との国交正常化に踏み切った父の朴正熙・元大統領の「日本の植民地支配に協力した人物」=「軍事政権時代の支配層の特権階級」というイメージを重ね合わせる風刺画になっている。

3つ目の財物損壊罪は、2015年11月に作成した朴槿恵大統領の風刺画です。2015年11月の民衆総決起(大規模デモ)を前に、海外歴訪に出発し大統領に「いってらっしゃい」とあいさつした絵です。ソウルの地下鉄・弘大入口駅5番出口の工事現場の仮囲いに描きました。ここは知る人ぞ知るグラフィティ天国です。ですから、私も帽子もかぶらないで気軽に作業をしました。ところが、作業をした次の日、私の絵だけが消されていました。被害者(韓進重工業の工事関係者)が通報もしなかったのに、警察が被害者を訪ね「美観が損なわれる」という陳述を得て捜査に着手しました。この件も在宅起訴されました。

この3つの事件を併合したのが今回の裁判です。懲役1年6カ月を求刑した検事が誰なのか、起訴状には出てこないのでわかりません。3つの事件すべて検事が違うからです。在宅起訴の状態で、そして初犯ではないので、このような量刑になったようです。

取調べで警察は、なぜ大統領を誹謗する絵を描いたのか、絵はどういう意味なのかを尋ねました。罪名は財物損壊罪なのに、絵の内容を尋ねる理由は何でしょうか? 大統領の風刺画でなかったとしても、このような質問をしたでしょうか? いや、取調べ自体、始めていたでしょうか?

まさか求刑通りの判決が出ることはないでしょう。しかし、何カ月かでも実刑を食らうことになれば、インドに出国することもできず、公判直後にその場で監獄行きだといいます。

私は間違ったことはしていません。風刺をしなくていい、集会に出る必要もない社会にしてくれればいいのです。世の中があまりにお笑いぐさなので、笑える言語で笑いながら作っているだけです。いまでもひっくり返らない世の中が不思議です。

最終弁論で話したことです。

「セウォル号は今も海の中にありますが、私の手でそれを引き揚げることができないので、集会に出て、そして絵を描いたのです。風刺画は弘大5番出口のグラフィティ空間で描いたものであり、そこにはあらゆる悪口と煽情的な絵が今でも残っています。ところが私の絵だけ消され、警察は被害者が通報もしなかったのに、陳述を引き出し、取調べに着手しました。我慢できずに作成した風刺画です。私は今後も集会に出て、そして芸術活動もします」。

判決は11月11日午前9時50分にソウル西部地裁で言い渡されます。その時まで何をするか悩んでいます。ここは巨大な監獄のようです。
